AJS WORKWEAR – TERMS & CONDITIONS

These Terms & Conditions apply to all orders placed with AJS Workwear (“we”, “us”, “our”) via our website, email, telephone, social media, or in person. By placing an order, you agree to these Terms.

 

Important: These Terms do not affect your statutory rights (including your rights in respect of faulty or misdescribed goods).

2. Definitions

  • Personalised / Customised Goods: Any items altered or produced to your specification, including (without limitation) embroidery, printing, names/initials, bespoke logo placement, custom colourways, and garments ordered specifically for you.

  • Plain Goods: Garments supplied without any personalisation/customisation.

3. Quotes, Prices & Payment

3.1 All prices are shown in GBP (£). VAT is included where stated or where applicable.
3.2 Quotes are valid for 30 days unless stated otherwise and may change if supplier costs change or if your requirements change.
3.3 Payment terms: unless agreed in writing, full payment is required before production and/or dispatch, especially for Personalised/Customised Goods.
3.4 We reserve the right to refuse or cancel any order where payment has not cleared.

4. Artwork, Logo Set-Up & Customer Approval

4.1 You confirm you have the right to use any logo, trademark, image, or design you provide to us.
4.2 You are responsible for checking spelling, sizes, garment colour, logo placement, and all artwork details before approving production.
4.3 Where we provide a proof/mock-up (digital or otherwise), your approval confirms the design is correct. Once approved, changes may not be possible and may incur additional cost.
4.4 Due to the nature of embroidery/printing, minor variations in colour tone, thread shade, placement (within reasonable tolerance), and print/embroider appearance may occur and are not considered defects.

5. Sizing & Garment Selection

5.1 It is your responsibility to select the correct garment type, size, and fit.
5.2 If you are unsure, we recommend ordering samples (plain where possible) before placing a larger branded order.
5.3 Where garments are ordered specifically for you from a supplier, they may be treated as Customised Goods for cancellation/returns purposes if they cannot reasonably be resold.

6. Production Times & Stock Availability

6.1 Production times are estimates and can vary depending on order size, complexity, artwork set-up, supplier stock, and seasonal demand.
6.2 If stock becomes unavailable, we will contact you with alternatives or a revised lead time.

7. Delivery, Postage & Risk

7.1 We deliver across Northern Ireland and can supply the wider UK by post/courier.
7.2 Delivery times are estimates and not guaranteed. We are not responsible for delays caused by couriers, weather, or events outside our control.
7.3 Risk passes to you on delivery. Please inspect deliveries promptly and notify us of any issues in line with Section 9.

8. Cancellations, Returns & Refunds

8.1 Personalised / Customised Goods (Embroidery/Print) – No “Change of Mind” Refunds

Because these items are made to your specification, Personalised/Customised Goods are non-refundable and non-returnable if you change your mind, order the wrong size, or supply incorrect artwork/text details. This is consistent with the consumer law exemption for personalised goods. 

However, this does not affect your rights if the goods are faulty or we have made an error (see 9.1).

8.2 Plain (Non-Personalised) Goods

If you purchase Plain Goods as a consumer (B2C), you may have a legal right to cancel within 14 days of receiving your order, provided items are unused, in original packaging, and suitable for resale.
Return postage costs are your responsibility unless the goods are faulty or incorrect.

8.3 Business-to-Business Orders (B2B)

Where you buy as a business, statutory consumer cancellation rights do not apply. Returns or cancellations are only accepted if agreed by us in writing.

9. Faulty, Damaged or Incorrect Items

9.1 If your order arrives faulty, damaged, or incorrect due to our error, contact us within 48 hours of delivery with:

  • order number

  • description of the issue

  • clear photos of the item(s), including branding/defect

9.2 Where a fault or error is confirmed, we will (at our option):

  • repair,

  • replace, or

  • refund (in full or in part)
    in line with your statutory rights.

9.3 We are not responsible for faults caused by: misuse, incorrect washing/care, general wear and tear, or damage after delivery.

10. Care Instructions

10.1 You must follow the care instructions supplied with the garment.
10.2 We are not liable for shrinkage, colour run, cracking, or damage caused by washing, drying, ironing, chemicals, or heat contrary to instructions.

11. Intellectual Property & Use of Images

11.1 You retain ownership of your logos/designs. You grant us a licence to use them solely to produce your order.
11.2 Unless you request otherwise in writing, you agree we may use photographs of finished items for our portfolio/marketing (with no confidential information shown).

12. Limitation of Liability

12.1 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under law.
12.2 Subject to 12.1, our total liability is limited to the amount paid for the relevant order.

13. Events Outside Our Control (Force Majeure)

We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including supplier disruption, courier delays, severe weather, strikes, or outages.

15. Governing Law

These Terms are governed by the laws of Northern Ireland / United Kingdom, and disputes will be subject to the courts of Northern Ireland (unless consumer law requires otherwise).
